On Sep 23, 2026, the DSA's annual Direct Selling Day on Capitol Hill brought 105 participants (including 87 independent direct sellers) from 15 companies, 26 states and 59 congressional districts to meet lawmakers. Delegates asked members to support H.R. 3495, the Direct Seller and Real Estate Agent Harmonization Act, which the DSA says would align how direct sellers are treated under the Fair Labor Standards Act with their classification in the federal tax code. The bill has cleared the House Committee on Education and Workforce and is awaiting House floor consideration. The DSA also cited its 2026 DSEF Growth & Outlook Study figures of 5.2 million US direct sellers and $34.2 billion in 2025 US retail sales. Party-plan companies depend on consultants being independent contractors, and this bill is aimed at protecting that status under federal labor law.
